Terms of service
1. GENERAL INFORMATION
The Sendit Custom store (“Seller”) is operated as a non-registered business activity under Polish law, within the limits permitted by applicable regulations (including monthly revenue thresholds).
These terms define the rules for using the store and concluding distance sales contracts.
The Seller provides services and sells products within Poland and other European Union countries.
2. DEFINITIONS
Customer / Consumer – a natural person purchasing goods not directly related to business activity.
Business Customer – an entity purchasing goods in connection with business activity.
Goods – products offered in the store.
Sales Agreement – a distance contract concluded between the Customer and the Seller.
3. CONCLUSION OF CONTRACT
Placing an order constitutes an offer to purchase.
The contract is concluded at the moment the Seller confirms acceptance of the order.
The Seller may refuse to fulfil an order in case of:
- non-payment
- incorrect data
- inability to fulfil the order
4. PRICES AND PAYMENTS
All prices are given in Polish zloty (PLN) or euro (EUR) and include VAT where applicable.
Delivery costs are charged separately.
The price is valid at the time the order is placed.
The Seller reserves the right to technical pricing errors – in such cases, the Customer will be informed before order fulfilment.
5. DELIVERY
Delivery is carried out within Poland and the EU.
Delivery times are indicative.
The Seller is not responsible for delays caused by the carrier or force majeure.
Risk of loss passes to the Customer at the moment the goods are handed over to the carrier (according to EU law – the Consumer retains complaint rights).
6. RIGHT OF WITHDRAWAL (EU – 14 DAYS)
The Consumer has the right to withdraw from the contract within 14 days without giving any reason.
The period begins from the day the goods are received.
To exercise the right of withdrawal, the Customer must inform the Seller (e.g. by email).
Refunds are issued within a maximum of 14 days after receipt of the returned goods.
The Customer bears the cost of returning the goods (unless otherwise agreed).
The right of withdrawal does not apply to:
- personalised products (e.g. custom graphics, made-to-order prints)
7. COMPLAINTS (LIABILITY FOR NON-CONFORMITY – EU)
Products are covered by the Seller’s liability for non-conformity with the contract (2 years in the EU).
Complaints can be submitted via email.
Complaints will be reviewed within 14 days.
The Customer may request:
- repair
- replacement
- price reduction
- withdrawal from the contract (in justified cases)
8. PERSONALISED PRODUCTS
Products made to individual order are non-refundable if produced in accordance with the Customer’s specifications.
The Customer is responsible for the correctness of submitted data (graphics, text, etc.).
9. LIABILITY
The Seller is liable towards Consumers in accordance with EU and Polish law.
Nothing in these terms excludes or limits Consumer rights under applicable legislation.
For business Customers, liability may be limited to the extent permitted by law.
10. PERSONAL DATA (GDPR)
The data controller is the Seller.
Data is processed for the purpose of order fulfilment.
The Customer has the right to:
- access their data
- rectify their data
- delete their data
- restrict processing
Data may be shared with payment processors and delivery companies.
11. COMPLAINTS AND DISPUTES
The Customer has the right to use out-of-court dispute resolution methods.

12. PROHIBITED USE
It is prohibited to:
- use the store unlawfully
- attempt hacking or system interference
- copy store content without permission
13. APPLICABLE LAW
Polish law applies to all contracts.
For EU Consumers, mandatory consumer protection laws of their country of residence also apply if they are more favourable.
14. CHANGES TO TERMS
The Seller may change these terms. Changes do not affect already placed orders.
